TERMS AND CONDITIONS

  1. Applicability
    1. These general terms and conditions apply to all offers, orders and agreements of CHPTR-S.
    2. Accepting an offer or doing an order means that you accept the applicability of these conditions.
    3. Of the provisions of these terms and conditions, only in writing can be deviated from in which the other provisions remain in full force.
    4. All rights and claims, as stipulated in these conditions and in any further agreements for CHPTR-S, are equally stipulated for intermediaries and other third parties engaged by CHPTR-S.
  2. Offers / Agreements
    1. All offers from CHPTR-S are without obligation and CHPTR-S expressly reserves the right to change prices, in particular when it is necessary on the basis of (legal) regulations. See also Article 3.6.
    2. An agreement is only achieved after acceptance of your order by CHPTR-S. CHPTR-S is entitled to refuse orders or to connect certain conditions to the delivery, unless explicitly determined differently. If an order is not accepted, CHPTR-S shall inform this within five (5) working days after receiving the order.
  3. Prices and payments
    1. The prices quoted for the products and services offered are in euros, including VAT and inclusive handling and shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing.
    2. Payment must be made without a discount or compensation within ten (10) days after the invoice date if the deliveries within the Netherlands are concerned, and within ten (10) days after the invoice date if deliveries outside the Netherlands, unless otherwise agreed in writing.
    3. Payment can be made per prepayment, via iDEAL Telebankieren, Paypal or with Visa credit card, Mastercard and American Express. When paying by bank or Giro, the date of payment is the date of crediting the Giro or Bank account of CHPTR-S. It is also for customers from the Netherlands and Belgium to pay afterwards via Klarna.
      If you pay your order via Klarna (pay afterwards) you also agree to the terms of Klarna.
    4. If the payment period is exceeded, CHPTR-S can determine whether or not the order is canceled.
    5. If the prices for the products and services offered are rising during the period between the order and its implementation, you are entitled to cancel the order or to dissolve the agreement within five (5) days after the price increase by CHPTR-S.
  4. Delivery
    1. To know the delivery times specified by CHPTR-S; For items that are in stock, a delivery time from 3 to 5 working days applies. For items that are not in stock, CHPTR-S will notify you in a timely manner and offer you the opportunity to terminate the agreement or to come across a new delivery time with CHPTR-S. Upon dissolution of the agreement, amounts already paid within 14 days are refunded.
    2. The delivery of the products takes place at the place and the time when the products are ready for shipment to you.
  5. Retention of title
    1. The property of supplied products will only pass if you have paid all of any agreement to CHPTR-S on the basis of any agreement. The risk with regard to the products is already on you at the time of the episode.
  6. Intellectual and industrial property rights
    1. You must respect all intellectual and industrial property rights in which the products supplied by CHPTR-S to respect completely and unconditionally.
    2. CHPTR-S does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and / or industrial property rights of third parties.
  7. Article 7. Return / right return
    1. You have the obligation to investigate or answer the products to the Agreement upon delivery. If this is not the case, you must inform CHPTR-S of this as soon as possible and in any case within thirty (30) days (weekend) after the delivery, at least after notification was reasonably possible, notify written / email.
    2. If it has been demonstrated that the products do not meet the agreement, CHPTR-S has the choice to replace the relevant products against their returns with new products if in stock.
    3. If you do not want to decrease a product for any reason, if Private Person, you have the right to return the product within thirty (30) days (weekend) after delivery to CHPTR-S. The following conditions apply: the article may not be used and must be returned undamaged and completely in the original packaging. The costs for return shipments come for your account.
      Note: articles that are not returned in original condition as well as Final Sale (-70% articles) are not accepted and returned sender, with the result that your purchase amount will not be refunded.
  8. Guarantee
    1. CHPTR-S guarantees that the products to be delivered meet the usual requirements and standards that can be made and are free of any defects.
    2. If the goods to be delivered do not meet this warranty, CHPTR-S will not reasonably notice the case within a reasonable time after receipt, if it is reasonably possible, written notice in respect of the defect by buyer, by choice of CHPTR-S, Replace or care for recovery.
    3. The aforementioned guarantee does not apply if the defect is created as a result of improper or improper use or when, without written permission from CHPTR-S, buyer or third parties have changes or trying to make it to the product or have used them purposes for which this product is not intended.
    4. In addition to these warranty provisions, legal warranty provisions remain in force.
  9. Orders / Communication
    1. For misunderstood, mutilation, delays or not properly overdue of orders and communications as a result of the use of the internet or any other means of communication between you and CHPTR-S, or between CHPTR-S and third parties, to the extent concerning the Relationship between you and CHPTR-S, CHPTR-S is not liable, unless and if they are allowed to be intent or gross negligence of CHPTR-S.
  10. Force majeur
    1. Without prejudice to the remaining rights, CHPTR-S in the event of force majeure has the right to suspend, at its own choice, the execution of your order, or to dissolve the agreement without judicial intervention, by sharing this in writing And without CHPTR-S to be kept to any compensation, unless this would be unacceptable in the given circumstances to standards of reasonableness and fairness.
    2. Force majeure is understood to mean any shortcoming which cannot be allocated to CHPTR-S because it is not due to its debt and nor under the law, legal act or views applicable in traffic.
  11. Article 11. Miscellaneous
    1. If you submit to CHPTR-S in writing of an address, CHPTR-S is entitled to send all orders to that address unless you do in writing to ChPTR-S from another address to which your orders should be sent.
    2. If or not tacit deviations from these conditions are permitted by CHPTR-S for short or longer periods, it is without prejudice to its right to demand direct and strict compliance with these conditions. You can never let any rights apply on the basis of the fact that CHPTR-S applies these conditions.
    3. If one or more of the provisions of these terms and conditions or any other agreement with CHPTR-S were conflict with any applicable legal regulation, the relevant provision will be canceled and it will be replaced by a new right to be established by CHPTR-S permissible comparable determination.
    4. CHPTR-S is authorized to use third parties in the execution of your order (s).
  12. Applicable law and competent court
    1. Only Dutch law applies to all rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions.
    2. All disputes between parties will be submitted to the competent court in the Netherlands upon exclusion.
  13. Copyright / Copyright
    1. On all images or portions of images available on this website. Without the express authorization of the author, multiplication of printing or complete text areas of downloaded documents is strictly prohibited from copyright files / photography based on copyright.
